Pet Mess Express LLC – Terms of Service

Contractual Requirements
Offer:
Pet Mess Express LLC offers scheduled pet waste removal services with customizable frequencies (one-time, weekly, every two weeks, and monthly). On the initial visit, a Pet Mess Express LLC Technician will walk the property with the owner to discuss expectations, highlight areas of concern, provide an overview of services, and issue a quote for the initial cleanup. Additional charges may apply for larger yards, front yard services, difficult terrain, takeaway, deodorizer, and deterrent.
Acceptance:
Clients accept these terms by using Pet Mess Express LLC’s services, submitting requests online, or maintaining an active service subscription. Continued use of Pet Mess Express LLC services constitutes agreement to all current terms.
Consideration:
The client’s use of Pet Mess Express LLC’s services and Pet Mess Express LLC’s provision of such services in exchange for payment constitute valid consideration, establishing a binding agreement.
Intention to Create Legal Relations:
These Terms of Service are intended to form a legally enforceable agreement between Pet Mess Express LLC and its clients.
Essential Clauses
User Guidelines and Restrictions (Client Responsibilities):
Access: Clients must provide unobstructed, safe access into and out of service areas. Locked, frozen, or otherwise inaccessible gates, as well as aggressive pets, will result in skipped visits without refund.
Clients must notify Pet Mess Express LLC immediately of any changes in the number of pets.
Clients must pay any outstanding balances promptly.
Yard Maintenance and Conditions: Clients must maintain their yards in a condition that enables effective service. Excessive leaves, tall grass, and debris may prevent complete waste removal.
Pet Behavior: Clients must inform Pet Mess Express LLC of any aggressive pets. Services may be suspended without refund due to safety concerns.
Bites: If a technician is bitten, the client must provide proof of vaccination, pay all related medical expenses, and a $500 fine. Services will be suspended without refund.
Termination and Suspension (Scheduling and Cancellations):
Pet Mess Express LLC operates from sunup to sundown, rain or shine, but does not guarantee exact service times.
Services may be postponed due to inclement weather or hazardous road conditions. We will attempt to reschedule service as soon as possible. If we are unable to do so, service will resume the following week. We do not offer refunds in these cases due to the increased amount of waste that will accumulate.
Major holidays may cause service pauses with prior notification. Pet Mess Express LLC will attempt to service clients either the day before or the day after the holiday unless clients specify alternative preferences through approved communication methods (email, phone, or customer portal).
If for any reason your pet(s) will not be using the yard for a certain period (i.e. vacation, illness, etc.) and you do not wish to be charged for an unnecessary visit(s), please let us know in advance to pause the service.
Clients may cancel or modify services with 48 hours’ notice. Cancellations made within 24 hours of the next visit are only partially refundable.
Subscription services may be paused or canceled at any time. However, if paused or canceled for over 30 days, an initial service charge may apply upon reactivation.
Services may be suspended for late payments, repeated access issues, employee injury due to a dog bite, repeated failure by the client to secure dogs during scheduled service despite requests, or any other issue deemed necessary by Pet Mess Express LLC ownership.
All suspended or terminated services initiated by either party will include written reasoning prior to cancellation. Unpaid balances are due within 15 days.
Billing and Payments:
Payment Methods: Clients must have a valid credit/debit card on file. Payments are processed every four weeks in advance of service.
Rates: Service rates are based on yard size, number of pets, and frequency of visits.
Fees and Promotions: Fees and promotions are subject to change at any time. In this rare circumstance, you will be notified at least two (2) weeks prior to changes.
Payment Timing: Payments are paid prior to service. Accounts will be suspended if payment is not received prior to next pay period until payment is received.
Refunds: Refunds are generally not provided for missed services unless the issue is caused by Pet Mess Express LLC. Refunds will be issued on a case-by- case basis.
Copyright and Intellectual Property:
All content, logos, service methods, and branding used by Pet Mess Express LLC are protected and may not be used, copied, or modified without written consent.
Warranty Disclaimer:
Pet Mess Express LLC services are provided “as is.” Pet Mess Express LLC disclaims all warranties, express or implied, and is not liable for issues arising from factors beyond its control (e.g., yard conditions, access issues, weather, acts-of-God).
Limitation of Liability:
Pet Mess Express LLC’s liability is limited to the amount paid by the client for services in the 30 days preceding a claim. Pet Mess Express LLC is not responsible for damage caused by concealed hazards, unsafe yard conditions, or aggressive animals.
Governing Law and Dispute Resolution:
These terms are governed by the laws of the United States of America. Disputes will be resolved first through good-faith negotiation, followed by mediation or arbitration if necessary.
